Terms & Conditions (T&C)

Bozark

1. Scope

These Terms and Conditions (“T&C”) apply to all orders placed by consumers and businesses through our online shop Bozark (“Shop”, “we”, “us”, “Bozark”).
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are not related to their commercial or professional activity (§ 13 German Civil Code – BGB).

By placing an order, you accept the version of these T&C valid at the time of purchase.

2. Contract Partner

3. Conclusion of Contract

The presentation of products in our shop does not constitute a legally binding offer but rather an invitation to place an order.

By clicking the “Buy Now” / “Order” button, you submit a binding offer for the products in your shopping cart.

The contract is concluded once you receive an order confirmation by email.

We reserve the right to refuse orders in justified cases (e.g., suspicion of fraud, incorrect information, stock errors).

4. Prices & Payment

All prices include German VAT and are exclusive of shipping costs unless otherwise stated.

Accepted payment methods are displayed during checkout (e.g., credit card, PayPal, Klarna, Shopify Payments).

Payment is due immediately after completing the order.

5. Shipping & Delivery

Products are delivered to the address you provide.

Delivery times are displayed in the shop.

If an item is unavailable, we will inform you immediately and refund any payments already made.

The risk of loss transfers to you once the delivery is made to your address.

6. Retention of Title

Goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory 14-day right of withdrawal under EU and German law.
The full withdrawal instructions can be found in our separate Right of Withdrawal document.

Businesses (B2B customers) do not have a right of withdrawal.

8. Returns & Refunds

Details are provided in our Return & Refund Policy, which exists independently of the statutory right of withdrawal.

You are responsible for return shipping costs unless otherwise stated.

9. Warranty

The following statutory warranty rights apply:

  • 24 months for consumers

  • 12 months for businesses

The warranty does not apply to damages caused by improper use, misuse, or normal wear and tear.

If you receive defective goods, please contact us immediately at info@bozark.de and include photos and order details.

10. Liability

We are fully liable for:

  • Intent and gross negligence

  • Injury to life, body, or health

  • Claims under the Product Liability Act

In cases of simple negligence, we are liable only for breaches of essential contractual obligations (“cardinal obligations”) and only for foreseeable, typical damages.

Bozark is not liable for:

  • Indirect damages

  • Loss of profit

  • Damages caused by improper use of the product

11. Data Protection

We process personal data in accordance with the GDPR and German data protection laws.

12. Accounts & Website Use

You are responsible for keeping your account and password confidential.

You may not misuse the website or engage in harmful activities, such as hacking, bypassing security systems, or placing fraudulent orders.

13. Dispute Resolution

The EU Commission provides an online dispute resolution (ODR) platform.
We are neither obliged nor willing to participate in dispute resolution procedures before a consumer arbitration board.

14. Applicable Law

These T&C are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

Mandatory consumer protection laws of your country of residence remain unaffected.

15. Severability Clause

If any provision of these T&C is found invalid, the remaining provisions shall remain unaffected.
